Terms of Service (DO-IP)

Applies to: doinsights.crg.ca (the "Service"), operated by Context Research Group Inc. ("CRG", "we", "us", "our").

1) Acceptance

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2) Who may use the Service

  • You must be 18+ and capable of entering a binding contract.
  • The Service is account-based and open to the public to register. Account sharing is not permitted.

3) The Service

The Service provides access to tourism insights and related content (reports, dashboards, analytics, alerts, and similar features). We may modify, suspend, or discontinue the Service (in whole or in part) at any time, including for maintenance, updates, or compliance purposes. Where practicable, we will provide advance notice of material service interruptions.

4) No SLA

The Service is provided on a best-efforts basis with no uptime or availability guarantees.

5) Acceptable Use

You must not:

  • Scrape, crawl, harvest, or bulk-download content (including via bots).
  • Bypass or probe security, or attempt to access non-public areas.
  • Reverse engineer or copy source data, models, or code.
  • Use automated queries that degrade performance.
  • Use the Service to compete with us, or to develop a competing product.
  • Upload or transmit malware, unlawful, or harmful content.
  • Misrepresent identity or affiliation.

We may suspend or terminate accounts that violate these Terms.

6) Intellectual Property & Licences

  • Our content. All content on the Service—including reports, data visualizations, text, graphics, and trademarks—is owned by CRG or our licensors (including Destination Ontario materials).
  • Your licence. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for internal business or non-commercial purposes, subject to these Terms.
  • Feedback. If you give us feedback or suggestions, you grant CRG a perpetual, royalty-free licence to use them without restriction.

7) User Content

The Service does not accept user uploads (e.g., files, images, comments). If you submit support inquiries or similar communications, you are responsible for their accuracy and legality.

8) Third-Party Materials

Some content and tools are provided by third parties or include third-party rights (e.g., Destination Ontario materials). Those may be subject to additional terms or attribution.

9) Privacy

Your use is also governed by our Privacy Policy (below), which explains what we collect and how we use it.

9A) Data Handling

We collect and store limited account and usage data necessary to operate the Service. Data is stored in Canada (or as otherwise disclosed in our Privacy Policy) and retained only as long as necessary for business or legal purposes. You may request deletion of your account and associated personal information in accordance with our Privacy Policy.

10) Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRG AND OUR AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (IF ANY). NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY TO THE EXTENT IT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12) Indemnity

You agree to defend and indemnify CRG, its affiliates, and employees against any claim or liability arising from (a) your use of the Service in violation of these Terms, or (b) your violation of law or third-party rights. CRG will defend and indemnify you against third-party claims alleging that the Service, as provided and used in accordance with these Terms, infringes intellectual property rights.

13) Termination

We may suspend or terminate access for any breach or suspected misuse. You may stop using the Service at any time. Following termination, we may retain minimal logs as required by law. We may provide a 30-day window to export any permitted materials you are entitled to keep.

14) Changes

We may update these Terms by posting a revised version and, where material, notifying you by email. Continued use after the effective date constitutes acceptance.

15) Entire Agreement and Severability

These Terms constitute the entire agreement between you and CRG regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full effect.

16) Governing Law & Venue

These Terms are governed by the laws of Ontario, Canada. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario.
